      Sir Gooroodas Banerjee in his book Hindu Law of Marriage and Stridhana, 4th Edition (re-Printed in India in )” lays down as under: “A Hindu husband is always permitted to marry again during the lifetime of his wife, though such marriage, if contracted without just cause, is strongly disapproved. “The first is the wife. Hindu law is a personal law. So, Hindu law should define ‘who is a Hindu’, and upon whom the Hindu law applies. A portion of Hindu law has been codified by Parliament in four Acts-i) The Hindu Marriage Act, ii) The Hindu Minority and Guardianship Act, iii) The Hindu Adoption and Maintenance Act, iv) The Succession Act, Author: Khaled Saifullah.

    Prior to , two kinds of properties were recognized by Hindu texts and writings with respect to women – Stridhana and non-Stridhana properties. Stridhana Property It occupies a prominent place in the Sanskrit law books that had been written in ancient India. Sources of Hindu Law: A critique “ Hindu law has the oldest pedigree of any known system of jurisprudence, and even now it shows no sign of decrepitude.”- Henry Mayne. The phrase “source of law” has several connotations. It may be the authority which issues rules of conduct which are recognized by Courts as binding.

    With the passage of time, a good number of laws were passed to strengthen the economic position of women but the Hindu Succession Act, needs a special mention. Under the provisions of this Act, a daughter is an equal sharer of her parental property and is an absolute owner of stridhana. The Hindu law books try their best to delineate the roles and responsibilities of each partner in a marriage so as to avoid any confusion. The couple have to follow their family rules and make sure that they do not contribute to the social disorder.
